General Terms and Conditions (GTC)

1. Scope of application

For the use of this website and the business relationship between Kohler's Bridges and its customers, the following General Terms and Conditions (GTC) and the data protection provisions listed under point 8 apply in their current and valid version at the time of accessing the website or ordering goods.

A customer is any natural or legal person who has a business relationship with kohlers-bruecken.ch. The GTC, the terms of delivery and payment and the data protection provisions may be amended from time to time. Customers are requested to read these provisions carefully each time they visit the website and each time they order goods.
These General Terms and Conditions apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of Kohlers Brücken in order to be valid. By using this website or ordering goods, the customer agrees to these GTC, including the terms of delivery and payment, in full.

 

Kohler's Bridges sells various bridge models and designs. We reserve the right to change prices, product ranges and content. All information on www.kohlers-bruecken.ch such as product descriptions, page numbers, illustrations, delivery times and other details are to be understood as approximate values only and do not constitute any assurance of properties or guarantees. Kohlers Brücken endeavours to provide correct, complete, up-to-date and easily understandable information on this website, but accepts no liability or guarantee, either express or implied.

All offers on this website are subject to change and non-binding.

 

2. Prices

Unless otherwise stated, the prices of Kohle'rs Bridges do not include VAT and are quoted in Dollars (US).
The shipping costs (incl. packaging) are charged additionally, unless otherwise stated, and are to be paid by the customer. The shipping method can be selected during the ordering process and is shown separately under the shipping costs item.
Kohlers Brücken reserves the right to change prices at any time and without prior notice.

 

3. Conclusion of contract

The offers on this website represent a non-binding invitation to the customer to order goods from Kohlers Brücken. By placing an order via this website, including acceptance of these GTC, the customer makes a legally binding offer to conclude a purchase contract. The customer is bound by the order. Unless otherwise stated, there is no right of return, cancellation or withdrawal.
The contract is concluded when Kohlers Brücken sends a declaration of acceptance by e-mail, in which the dispatch of the ordered products is confirmed or the ordered products are delivered to the customer.
Orders will only be processed and delivered after full payment has been received. If it transpires after conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, Kohlers Brücken is entitled to withdraw from the contract in whole or in part. If the customer's payment has already been received by Kohlers Brücken, it will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay. In the event of cancellation, Kohlers Brücken is not obliged to make a replacement delivery.

 

4. Payment options

In principle, the customer has the payment options specified in the order process at his disposal.

Kohlers Brücken reserves the right to exclude customers from individual payment options without giving reasons.

 

5 Delivery, obligation to inspect, notification of defects and returns

Deliveries are made by post or courier to the delivery address specified by the customer in the order. Invoices are issued exclusively by e-mail. The benefits and risks are transferred to the customer upon dispatch, insofar as this is legally permissible.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, Kohlers Brücken can withdraw from the contract after sending a reminder to the customer by e-mail, setting a reasonable deadline, and charge the costs for printing, packaging and despatch as well as handling costs (at least CHF 75) and any disposal costs. If a second delivery is necessary, the customer must bear the additional costs incurred and pay them in advance.
The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which Kohlers Brücken provides a warranty immediately in writing by letter (return address below) or by e-mail to lorenz@kohlers-bruecken.ch.

and shall be at the customer's expense and risk. The customer must send the goods in full, with a delivery note and a precise description of the defect, to the specified return address.
If the inspection by Kohlers Brücken shows that the goods do not have any significant, identifiable defects, Kohlers Brücken can insist on fulfilment of the contract and send the goods to the customer again. In this case, Kohlers Brücken is entitled to charge the costs for the second dispatch and the inspection costs in addition to the sales price.

 

6. Warranty

Kohlers Brücken endeavours to supply products of perfect quality. In the case of justified and timely notified defects, Kohlers Brücken assumes the warranty for freedom from defects. The warranty is provided at the discretion of Kohlers Brücken in the form of free rectification, equivalent replacement or (partial) reimbursement of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects caused by external circumstances. The warranty is also excluded for signs of wear and tear.

 

7. Liability

Kohlers Brücken excludes any liability, for whatever legal reason, as well as claims for damages against Kohlers Brücken and any auxiliary persons. In particular, Kohlers Brücken is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.
